Good Faith Agreement

Diorama Comics and name enter into this good faith agreement for the purpose of publishing, distributing, and selling comics.
  1. Copyright. All copyright in the material created by name remains with name, the author/artist/other (please circle all applicable) (and if any co-creators) and any co-creators (name(s)) of the work, Title Of Work. A copyright notice stating such shall be included in all copies of the work(s). Name affirms that all rights vested in this work belong solely and truly to them and such listed co-creators, and that the piece is their own original work and does not infringe on the intellectual property of anyone else, or include work by anyone not party to this agreement, except such works as may be in the public domain or other fair or permitted use of material.



  2. Publication. Diorama Comics is a publishing collective. All members and contributors of Diorama Comics are authorized publishing agents of Diorama Comics for the purpose of this license, and name accepts Diorama Comics’ right to define its own membership list for these purposes. Publication will only be done by Diorama Comics members and contributors, although sales may be made through second-party distributors.

  3. 4. Reciprocal publication. (For serials, one-shots and members.) As an ongoing member of Diorama Comics, name accepts responsibility to act as a publishing agent of Diorama Comics for the purposes of printing, distributing, selling, and otherwise promoting the work of the other members of Diorama Comics and Diorama Comics in general, as well as name’s own work.

    Reciprocal publication (Anthologies.) As a contributor to the Diorama Comics publication Title Of Anthology, which includes name’s work Title Of Work, name agrees to print at least ten (10) copies of Anthology, and to engage in their best efforts to distribute, sell, and otherwise promote said anthology, as well as to promote Diorama Comics.

  4. Remuneration. (For ongoing members.) Name shall be paid all the profits generated by their comic(s), as sold by all authorized publishing agents of Diorama Comics and other chosen second-party distributors. Profits are defined as the sum of the income from all sales minus total printing costs (and percentage taken by second-party distrubtors where appropriate: shops, conventions). If Title Of Work is a co-creation, money shall be split between all involved parties evenly/as they have agreed upon amongst themselves.

    Remuneration. (For non-charity anthologies.) Name will receive an equal share of the profits generated by Anthology, as will all other contributors. Profits are defined as the sum of the income from sales of this anthology minus total printing costs (and percentage taken by second-party distrubtors where appropriate: shops, conventions). There are number of contributors to Anthology, so name will receive % of the profits.

    (For all.) This money will be paid out quarterly, in April, July, October, and January of each year.

  5. Publishing costs. (For ongoing members.) Name is entitled to reimbursement in full for all publishing costs incurred in printing both their own work and other Diorama Comics titles, to be taken from monies received from the sale of said comics.

    Publishing costs. (Anthologies.) Name, having paid for the cost of printing at least ten (10) copies of Anthology, is entitled to reimbursement in full for all of these costs.

  6. Advertising. Diorama Comics will place advertisements for all its current titles in each comic it publishes. Name agrees to having these advertisements for other works included in their title(s), in exchange for having advertisements for their work(s) included in other titles.

  7. Free copies. Name may keep for their self or give away as many free copies of the work (Anthology) as they choose, but should keep in mind that this cuts into their profits, and the profits of others. It is advised that name sell more copies than they give away.

  8. Inventories and book-keeping. (For ongoing members.) When name prints copies of any Diorama Comics title, they should keep a receipt for all costs, and immediately send a copy of that receipt to the creator of each work, for that creators titles(s), and to Diorama Comics, for all titles.

    Also, name is to send an inventory accounting for all copies of every title sold per quarter, at the end of that quarter, to Diorama Comics headquarters, showing, for each title separately, printing costs, number of copies printed, number of copies sold, price per copy, total income, and profit (profit = total income – printing costs), amount kept for printing reimbursement and contributor pay for their own work(s), and amount returned to Diorama Comics. All money that is not reimbursement or payment must be sent to Diorama Comics along with this inventory. Inventories and money must be received by the 15th of April, July, October, and January each year. A sample inventory page will be provided to assist with accurate record keeping. Payments from profits generated by other members cannot be sent out until inventories and monies are received. This is important.

    (Anthologies.) When name prints copies of Anthology, they must keep a receipt for all costs, and send a copy of said receipt to the editor of the Anthology and/or Diorama Comics headquarters immediately, to show proof of cost.

  9. 10. Currency. Name should use their local currency, the one that is on any receipts for printing and sales, when writing up an inventory. They should use either their local currency, US$, UK pounds, or euros when sending money to Diorama Comics/editor in cash, check, or money order. For the sake of accuracy and lowered fees, however, PayPal is the preferred form of money transfer, and should be used as often as possible.
